Nintendo Suing Alleged Switch ‘Leaker Streamer’ For $7.5 Million

As a long-time gaming enthusiast and follower of the industry, I must say that the ongoing saga between Nintendo and Jesse ‘EveryGameGuru’ Keighin has been quite intriguing to watch unfold. It’s not every day you see a streamer taking on a tech titan like Nintendo!


Jesse ‘EveryGameGuru’ Keighin has faced criticism from Nintendo due to his frequent broadcasting of unauthorized Nintendo Switch games, which the tech company has asked him to cease streaming. Reports suggest that he ignored takedown warnings and legal orders to stop, finding ways around possible legal action, sometimes streaming games weeks ahead of their official release.

According to Nintendo, these actions involve spreading and advocating for the illegal download of upcoming video games that haven’t been released yet. Additionally, they claim that ‘EveryGameGuru’ has benefited financially from this behavior, as viewers are encouraged to donate money to support his content creation activities.

It Doesn’t Pay

Nintendo doesn’t mess around when it comes to copyright infringement and leaks.

This legal case poses a significant threat to Jesse ‘EveryGameGuru’ Keighin, whose popularity soared from regularly streaming pre-release Nintendo Switch games. For example, he was caught playing Mario & Luigi: Brothership nearly three weeks ahead of its release date, and he streamed Echoes of Wisdom about a week before it became available to the public.

Per the lawsuit, Nintendo has claimed:

As a gamer, I’ve got to be honest here – I was watching some streams that weren’t supposed to be there. Turns out they were sneaky previews, leaked before their official release by Nintendo. What made it worse is that these streams were promoting and even endorsing the download of unofficial, pirated game copies before they hit the market. Definitely not cool.

Following numerous copyright infringement complaints, Nintendo took a firm stand and prepared for legal action, potentially seeking a total of $7.5 million in damages. Each instance of violation is being targeted for potential compensation amounting to $150,000.

404 Media initially reported a lawsuit, uncovering that Keighin adopted a casual and light-hearted attitude towards Nintendo’s legal matters. On several occasions, it is alleged that he responded to them through emails in a way that seemed to taunt or mock them. At one instance, there were allegations that he boasted about having a thousand backup accounts (burner channels) and the ability to continue streaming effortlessly day after day.
