Summary
- The Eternal Darkness Sanity System patent has officially expired, meaning it’s now free for public use.
- Developers can implement the system, but copyrighted elements like visuals and specific effects remain off-limits.
- The Sanity System made characters hallucinate as their sanity dropped.
The patent for the “Eternal Darkness” Sanity System has expired, making it freely accessible to the public. However, there’s a caveat: since the system was originally a part of Nintendo’s intellectual property, there may be some restrictions when using it. One of the reasons “Eternal Darkness” is beloved by fans is undoubtedly its unique Sanity System, which played a significant role in the game.
Originally released for Nintendo GameCube in 2002, “Eternal Darkness” hasn’t been formally transferred to any other system. Unfortunately, due to the discontinuation of the GameCube, it’s no longer available for purchase. Regarded as a cult classic, Nintendo has shown no intent to keep the game alive. It provided a unique blend of horror and action-adventure, with a spin on the survival-horror genre. The narrative followed a college student investigating her grandfather’s murder, delving into various time periods such as ancient Rome and medieval France. A notable feature was its Sanity System, causing characters to experience hallucinations when their sanity levels decreased.
Reddit user DocMemory pointed out that Nintendo’s patent for the “Eternal Darkness” Sanity System expired on November 5, 2021, and is now marked as “Expired – Lifetime.” This means that since then, the public has been free to use any part of the system that is essential for its operation. However, copyright law protects artistic expressions like graphics and specific sanity effects, so they cannot be used without permission. Eurogamer consulted video game legal expert Richard Hoeg to confirm this interpretation.
Anyone Can Now Use Eternal Darkness’ Iconic Sanity System
Among the cherished aspects of Eternal Darkness that players often reminisce about is the Sanity System. Now, anyone has the opportunity to recreate this system in their own work, provided they avoid directly replicating elements from the game itself. In simpler terms, for those who might not recall it vividly, the Sanity System revolved around a character gradually losing their mental stability upon encountering horrifying entities or gruesome scenarios.
As the character’s sanity dwindled, they would begin to experience hallucinations, and the game would introduce unsettling elements – like visual distortions, eerie whispers, or even simulated glitches that appeared to erase the player’s saved progress – all of which drew players into the character’s descent into madness. Although Eternal Darkness is still confined to the GameCube, its former director has expressed interest in a remaster in the past. While no official announcements have been made about this, at least developers now have the opportunity to incorporate the renowned Sanity System into their own games.
