Asmongold Files Motion to Have Mizkif Lawsuit Dismissed

The legal dispute between Twitch streamers is continuing, with Zack “Asmongold” Hoyt recently asking the court to dismiss a defamation claim filed against him and Emily “Emiru” Schunk by Matthew “Mizkif” Rinaudo. As of today, the case involving all parties is still in progress.

Asmongold and Mizkif co-founded OTK, a media company based in Austin, Texas. Emiru joined as a co-owner in 2023. In October 2025, during a livestream, Emiru revealed she had previously been in a relationship with Mizkif, but that it had ended months earlier. She also accused him of sexual assault and blackmail, claiming he exploited her during a difficult time. Following these accusations, OTK announced that Mizkif’s contract had been terminated prior to the allegations and that over one million of his company shares had been taken back.

Asmongold Wants Mizkif’s Defamation Lawsuit Dismissed

Following accusations made against him, Mizkif sued Emiru and Asmongold in November 2025, seeking damages for defamation and financial losses resulting from his departure from OTK. Asmongold’s legal team has now asked the court in Texas to dismiss the lawsuit entirely, arguing that Mizkif hasn’t presented a valid legal case. They claim that any public statements made about Mizkif or his actions don’t justify a lawsuit. Alternatively, Asmongold’s lawyers suggested that Mizkif could strengthen his case by specifically identifying which comments made by the defendants he believes are actually defamatory.

Asmongold’s lawyers responded to Mizkif’s lawsuit by arguing that Mizkif, as a public figure, hadn’t provided a valid legal basis for his claims. They stated that Mizkif’s concerns weren’t legally actionable. Even though Asmongold left OTK in 2024, he continues to offer his opinions on the organization and its members during his livestreams. Asmongold’s lawyers also pointed out that Mizkif had previously admitted to aggressive behavior, like slamming doors, and using steroids, which allegedly caused him anger problems. They argued that under Texas law, repeating or agreeing with Mizkif’s own public statements isn’t defamation, and therefore Mizkif can’t successfully sue Asmongold for what he said.

Mizkif’s Legal Saga Is Far From Over

Mizkif’s legal team argues that any disagreements stem from opinions protected by free speech. Because Asmongold is a prominent content creator, he’s considered a public figure, meaning Mizkif would need to prove malicious intent to win his defamation lawsuit, rather than simply focusing on Asmongold’s statements. However, Asmongold’s request to dismiss the case only addresses claims made directly against him, not those involving Emiru or OTK. Currently, the court in Austin hasn’t made a decision for either side, and the outcome of the case – and its potential consequences – remains uncertain.

Mizkif is still facing legal problems, and the situation is getting worse. After Emiru shared her experiences in October, several other women have come forward with accusations of sexual harassment, abuse, and attempts to damage their reputations. Following his removal from OTK, Mizkif stopped streaming on Twitch and moved to Kick, a rival platform.
