Isn’t it remarkable how Intellectual Property (IP) law functions? Primarily, it serves as a shield for the creative works of individuals against larger entities trying to exploit their ideas. However, in today’s society, it seems that its impact is more noticeable among livestreamers who become anxious whenever someone plays music nearby due to potential copyright infringement concerns. Of course, there are other aspects as well.
Among the various topics, one that particularly interests Larian Studios is custom game modifications, or mods for short. As revealed in a recent interview, Swen Vincke, the CEO of Larian, strongly advocates for game development studios to reconsider their stance on user-created mods.
In an interview with GameSpot, he expresses his enthusiasm by saying, “Isn’t it amazing?” From a marketing perspective, it’s also the result of genuine passion and positive word-of-mouth.
Instead of going into detail, you might simply express, ‘Wow, what you’re working on is fantastic! Here’s the necessary license.’ This should take care of it.
Vincke discussed instances where developer-approved fan projects were showcased in an appealing manner, emphasizing that these actions convey a more powerful, optimistic message to fans. Instead of suppressing fan innovation, studios could nurture and encourage it as much as feasible.
As an avid gamer and fan, I couldn’t help but share this exciting tidbit: Not too long ago, in the realm of video game development, Bethesda, graciously bestowed a token of appreciation on the creators of the Skyblivion project following the re-release of The Elder Scrolls IV: Oblivion Remastered.
For quite some time, enthusiasts were creating their personal adaptations of Oblivion within Skyrim, even prior to the official announcement of the Oblivion remaster. However, once it became available, Bethesda provided every member of the team with a complimentary copy of the remastered version.
Vincke mentioned another instance, which is the Baldur’s Village mod – a creation that transfers characters from Baldur’s Gate 3 into Stardew Valley. Typically, getting intellectual properties to intersect like this through official means can turn into a complex legal issue. However, enthusiasts tend to execute such tasks on their own without payment.
You Can’t Keep A Good Fanbase Down

In discussing this topic, Videogamer used Pokemon ROM hacks as an example to support one of Vincke’s main arguments. Nintendo often takes strong action against projects that could potentially infringe their intellectual property rights. While small-scale ROM hacks fall under this category, they aren’t the only ones targeted – even larger projects like Palworld are still grappling with legal issues from Nintendo’s lawyers.
Despite Nintendo shutting down one project, devoted Pokemon fans continue to persevere with new endeavors popping up all the time. In fact, for every project Nintendo dismantles, there are roughly fifteen more in its stead. These takedowns may hinder progress, but they don’t entirely halt it. As long as there is no financial gain involved, fan projects will persist, and according to Vincke, companies should learn to accept this reality.
Vincke describes intellectual property (IP) law as essentially restrictive,” he explains. “It’s an exception to the idea of a free market, which is why there are so many complexities associated with it. This point is important because it influences companies to behave in unusual ways due to these restrictions.
In contrast to Nintendo’s unusual behavior, Larian aspires to conduct themselves appropriately. According to Vincke, companies should praise fans who create projects like these, possibly even granting them an official license. He suggests this approach benefits the creators, the players, and argues it’s simply easier (and more considerate) for the IP owners.
