Elon Musk Faces EU Probe Over AI Training In Austria

As a seasoned analyst with over two decades of experience in the tech industry, I have witnessed the evolution of data privacy concerns and the seemingly relentless pursuit by tech giants to push the boundaries of what is permissible. The allegations against Elon Musk’s X platform for alleged data violations are not surprising, given the growing trend of exploiting user information without consent.


On social media platform X, founded by Elon Musk, potential privacy law infractions are under scrutiny in Austria. It is alleged that personal data was exploited without consent for the purpose of training artificial intelligence. This breach of privacy regulations, a serious matter under EU law, has been brought to the attention of Austrian authorities by the privacy advocacy group NOYB, led by Max Schrems.

The issues raised here are strikingly similar to those voiced in the EU over the misuse of user data by tech companies without consent.

Elon Musk’s X Scrutiny Over Alleged Data Violations

In simple terms, NOYB’s complaint claims that the platform has been using personal data from EU users without their explicit consent since May 7th, 2024, up until August 1st, 2024. This data was collected specifically for training AI models. According to NOYB, this action violates the GDPR (General Data Protection Regulation) because there was no prior notification or seeking of consent from users regarding the processing of their data.

The advocacy group is urging the Austrian officials to conduct an investigation, ensuring adherence to European Union’s privacy regulations.

Simultaneously, the Irish Data Protection Commission (DPC), who oversees X within the EU, also initiated a lawsuit against the platform. The DPC seeks a court order to prevent Elon Musk from utilizing user data for AI training, as they claim the company’s actions violate GDPR regulations. This legal action aligns with similar efforts across Europe aimed at regulating how tech giants manage personal data.

AI Training Paused Amid Legal Pressure

Under the increasing legal pressure, the Elon Musk platform agreed to temporarily suspend the use of European user data for AI training on August 8. This was conveyed to the Irish High Court but the issue of how data collected prior to withdrawal of consent is dealt with has not been addressed. 

While privacy advocates consider this a partial win, NOYB contends that the legitimacy of the data processing remains unaddressed in this decision.

Despite ongoing discussions, the handling of data on the Musk platform remains a contentious issue. Not only has the Austrian NGO, NOYB, filed complaints against it in Austria, but also in Belgium and France.

European Scrutiny of AI Data Practices

The actions taken by the Data Protection Commission (DPC) against Elon Musk’s platform align with the growing scrutiny from European regulators towards large technology companies over their handling of personal data for AI training. Notably, in June, such concerns led the DPC to temporarily halt Meta’s AI projects within Europe.

Currently, Musk’s platform encounters comparable issues, and the outcomes of these legal proceedings could potentially shape the future guidelines for AI governance within the European Union quite profoundly.
