A US district court judge has made rulings on various motions, bringing more clarity to this legal dispute. The plaintiffs have accused payment firm Ripple Labs of violating securities laws. Simultaneously, the parties involved in the XRP lawsuit have arranged for settlement discussions, as mandated by the court.

Judge Issues Orders in Ripple Case

In the most recent court document, Judge Hamilton approved decisions on four motions based on the Daubert rule. This was advantageous for the plaintiffs, as the court predominantly sided with their requests.

As a researcher reporting on the XRP lawsuit, I’m sharing that the court has not granted the motions from defendants RippleLabs and XRP II to exclude the testimonies of experts Jeremy Clark and Saifedean Ammous. This means that both experts will be able to present their evidence in the case.

“Ripple’s control or lack of control over the XRP ecosystem is a factual issue relevant to the Howey test, and Clark’s testimony speaks to that issue.”

In the SEC vs. Ripple Labs case, heard in the Southern District of New York, Judge Analisa Torres took Schwartz’s testimony about investment contracts into account when evaluating the business intentions within the industry.

After holding a settlement conference at the end of September, a resolution has been reached. A pretrial conference is now scheduled for December 19, while jury selection and the jury trial have been arranged for January 21.

Over the past day, XRP’s price dipped below the $0.50 mark due to escalating Israel-Iran tensions and an ongoing money laundering probe into Tether by the U.S. Department of Justice. At present, XRP is being traded at around $0.514, representing a decrease of 6% over the past week. The lowest and highest points in the last 24 hours were $0.4936 and $0.527, respectively.
