Australia’s ASIC announced its intention to challenge the ruling that dismissed the case regarding Finder’s crypto asset product. ASIC believes that Finder’s “Earn” product was distributed without the required permit, leading to insufficient consumer safeguards.

Australia’s ASIC to Appeal Against Dismissal of Finder Crypto Asset Case

Based on the news, ASIC has initiated an appeal after the Federal Court rejected its case against Finder Wallet Pty Ltd. The charges against the company included offering unlicensed financial services, disregarding product disclosure regulations, and failing to comply with design and distribution obligations for their crypto asset-related product, named “Finder Earn.”

According to reports, the Finder Earn product, which ASIC claimed was a debenture, was challenged in court on March 14, 2024. The Federal Court, however, rejected ASIC’s arguments and dismissed the case. Despite this decision, ASIC remains convinced that the product was offered without proper authorization or a required license. As a result, they have chosen to appeal the ruling, citing concerns over the absence of essential consumer protections associated with the product.

Finder’s Discontinued Crypto Asset Product

The dismissal of ASIC’s case against Finder Wallet, a branch of Finder.com, by the Australian Federal Court came as a surprise to many in the market. Justice Brigitte Markovic announced this decision, which supported Finder Wallet’s compliance with financial regulations regarding their crypto assets.

The court dismissed ASIC’s allegations of failing to adhere to regulatory rules for financial offerings, emphasizing the importance of obtaining necessary licenses and ensuring compliance. Finder celebrated this outcome as a significant victory and was pleased with the resolution. Moreover, the company stated that it chose to discontinue Finder Earn based on business strategies rather than regulatory pressures, considering the changing market conditions such as increasing interest rates.
