Ripple v SEC: Critical Appeal Dates XRP Community Can’t Miss

The SEC’s decision to appeal last year’s ruling has ignited a renewed sense of anticipation among the XRP community, and rightly so.


With the U.S. Securities and Exchange Commission (SEC) filing an appeal in the Ripple case, the XRP community is currently zeroing in on several key deadlines that may determine the eventual resolution of this ongoing courtroom dispute.

Following Judge Analisa Torres’ decision last year which classified secondary XRP sales as non-securities, many people viewed it as a victory for Ripple. However, the debate over institutional sales has kept the case under scrutiny. Now, the SEC’s decision to appeal introduces fresh timeframes that both Ripple and XRP holders need to be aware of.

Important dates for the appeals process involve the submission of the SEC’s opening brief, which is tentatively scheduled for December 2, 2024. It’s anticipated that they will ask for a 30-day extension, thus moving the deadline to around early January 2025.

In reply, Ripple plans to submit a cross-appeal along with their argument, which is expected around the same period. Counterarguments will be presented subsequently, with dates set for early February 2025. However, Ripple has the option to delay this until March if necessary.

2025 and beyond

By next spring (March 2025), we’ll submit our written arguments, followed by oral arguments tentatively set for either September or October of the same year at the Second Circuit Court. A verdict from this court is anticipated no sooner than January 2026, but experts speculate a more probable decision around March or April that year instead.

If the situation continues to advance, it might stretch out the legal proceedings up to an extra 1.5 to 2 years, possibly pushing the resolution date into 2027 or later, according to legal expert Fred Rispoli’s analysis.
