As a seasoned analyst with over two decades of experience in political and legal matters, I find myself deeply troubled by Elon Musk’s latest endeavor, the America PAC giveaway targeting registered voters in swing states for the 2024 US Election.
The office of the District Attorney in Philadelphia has initiated a legal action against a political committee, which is largely influenced by billionaire Elon Musk, with the intention of preventing this committee from distributing $1 million among eligible voters who are registered for elections in key states, during the upcoming US elections.
A few days ago, District Attorney Larry Krasner took legal action, following a warning from the U.S. Department of Justice that Elon Musk’s political action committee could be breaking federal election laws with its $1 million sweepstakes.
A legal action has been initiated in the Court of Common Pleas of Philadelphia County, listing Elon Musk, CEO of Tesla, and America PAC as the parties being sued.
Philly DA: Musk’s Giveaway Threatens US Election Integrity
In a court filing on Monday, Philadelphia’s District Attorney Larry Krasner sought to prevent tech magnate Elon Musk from carrying out his contentious $1 million donation aimed at registered voters for the 2024 U.S. Election.
Krasner identifies as a Democrat and considers himself a forward-thinking district attorney. He filed a lawsuit against Musk and his political action committee, America PAC, which supports Trump’s policies.

In simpler terms, the role of the Philadelphia District Attorney involves safeguarding the public by preventing issues like public disturbances, unjust business practices (such as illegal lotteries), and tampering with election honesty.
Last week, the US DOJ has also warned Musk’s America PAC concerning its ongoing $M voter lottery, suggesting potential law violations. This, however, met a criticism by Dogecoin co-founder Billy Markus, who described the DOJ actions as politically motivated. He added that they resemble tactics often associated with authoritarian regimes.
A Giveaway Too Good to Be True – Legal Challenge Filed
As a crypto investor, I found myself in a peculiar situation when it was alleged that Elon Musk had promised a $1 million reward for individuals who shared their personal details such as addresses, phone numbers, emails, and signed petitions expressing support for the Constitution. This information exchange was part of the lawsuit’s claims.
The legal argument states that America PAC and Musk are enticing individuals from Philadelphia, the Commonwealth, and other decisive states by offering them the chance to win a million dollars, with the catch being they must share their personal details and make a political pledge.
The lawsuit states that the lottery setup by Elon Musk is claimed to be “definitely illegal,” as per Pennsylvania law, all state lotteries must be managed by official state representatives. Furthermore, it alleges that Musk’s lottery violates Pennsylvania’s consumer protection laws due to misleading, unclear, or ambiguous statements that may potentially deceive consumers.
As a researcher, I too find myself questioning the legality of Elon Musk’s recent actions. Michael Morse, an assistant law professor at the University of Pennsylvania Carey Law School, expresses that this method is questionable at best from a legal standpoint. While federal law prohibits payments to persuade someone to register to vote, Professor Morse suggests that a petition could potentially be considered an incentive for voter registration.
DA Krasner: PAC is a Threat to Public Interest and Election Integrity
In simpler terms, Krasner underlined that it is the duty of the District Attorney of Philadelphia to safeguard the public against public disturbances such as nuisances, unjust trading activities, and illicit lotteries.
He noted the DA’s role also involves safeguarding the public from actions that could compromise the integrity of elections.
Previously, America PAC encountered short inquiries from the North Carolina Attorney General’s department and the Michigan Secretary of State’s office. It was discovered that the PAC had been collecting information from voters in key states, claiming to help with voter registration, but it was actually under false pretenses.
