The legal dispute between Nintendo and accessory manufacturer Genki has been resolved, and it’s been decided that Nintendo will receive an unspecified amount of compensation (subject to approval of the proposed settlement). Additionally, as part of the settlement agreement, Genki must modify their product names and color schemes specifically for items compatible with the Switch and future Switch models like the Switch 2.
At CES 2025, Genki attracted attention when they claimed to have a duplicate of the yet-to-be-revealed Switch 2. This assertion led Nintendo’s legal team to visit Genki’s booth at CES to discuss the matter with the accessory manufacturer. As a result, Genki decided to close their booth shortly afterward. In May, Nintendo announced they were initiating a lawsuit against Genki due to false advertising, unjust competition, and trademark violation. This legal action led to a public statement from Genki on social media, where they acknowledged the news and mentioned they would follow the guidance of their legal representatives in the ongoing case.
Nintendo and Genki Have Settled For An Undisclosed Amount
Approximately four months after Nintendo filed a lawsuit against Genki (also known as Human Things) over their CES booth display, the legal dispute between the two companies seems to have reached a tentative resolution. As stated in a court filing with the U.S. District Court for the Central District of California, Genki has agreed to compensate Nintendo an undisclosed sum for damages. Furthermore, Genki will refrain from using product terminology that may be mistaken for Nintendo console-compatible terms, such as “Glitch” and “Glitch Direct,” which could potentially confuse consumers and resemble the Nintendo Switch and Nintendo Direct brands.
Additionally, Genki is prohibited from using any color combinations in their products that are similar to those used by Nintendo. Specifically, these color combinations include red and white, red and blue, green and pink, blue and yellow, purple and orange, pink and yellow, and purple and green.
Right now, I’m waiting on the final seal of approval for the proposed settlement between me (Nintendo) and Genki. If everything goes as planned, it’ll be another legal triumph in September for yours truly. Earlier this month, we reached an agreement with Modded Hardware, the folks behind the MiG Switch and similar hacking tools, over a $2 million compensation fee and a permanent restraining order. The order stops them from crafting or manufacturing any gear that tinkers with Nintendo systems, and they’ve got to hand over anything related to their business model directly to us.
Regardless of the court verdict, Genki continues to have the option to produce accessories for the Switch 2 and various other gaming platforms in the future. The upcoming actions of Genki after the Nintendo lawsuit remain uncertain.
